Certain records may be made available to clients, employees, contractors, service providers or other persons where the requester has a lawful or legitimate right to access them. Access may be subject to identity verification, confidentiality obligations, contractual restrictions, protection of third-party information, POPIA requirements and other legal restrictions.
8. How to Request Access
A requester seeking access to a record held by PIBG should submit the request in the manner and form required by PAIA and the applicable regulations. The request should provide sufficient information to identify the requester, the record or records sought, the right the requester seeks to exercise or protect where required, the preferred form of access and any other information reasonably necessary to process the request.
Requests should be directed to the Information Officer using the contact details in this Manual. PIBG may require the prescribed form and supporting information applicable to the request.
9. Verification and Authority
PIBG may require reasonable proof of identity before providing access to personal information. A person acting for another individual or organisation may be required to provide appropriate proof of authority.
10. Processing of Requests
Valid requests will be considered in accordance with PAIA and applicable law. Depending on the circumstances, access may be granted, partially granted, refused or deferred where legally permissible. PIBG may request clarification or additional information where necessary.
11. Grounds for Refusal
Access may be refused where PAIA or another applicable law permits or requires refusal. Relevant grounds may include protection of another person’s personal information, confidential or commercially sensitive information, trade secrets, intellectual property, privileged information, information supplied in confidence, safety or security interests, legal proceedings and third-party rights.
The existence of a record does not by itself mean that access must be granted.
12. Third-Party Information
Where a requested record contains information concerning another person or organisation, PIBG will consider the rights and interests of that party and may consult or notify the third party where required by law.
13. Personal Information and POPIA
PIBG processes personal information in accordance with POPIA. Its Privacy Policy describes the purposes of processing, categories of information, recipients or categories of recipients, data-subject rights, security safeguards and other relevant privacy matters.
14. Access, Correction and Deletion of Personal Information
A data subject may request access to personal information held about them and may request correction or updating where the information is inaccurate, misleading, outdated or incomplete. Requests for deletion are subject to applicable legal and retention requirements.
15. Fees
Certain requests may attract fees prescribed by PAIA and applicable regulations. Where a fee is payable, PIBG will provide the relevant information before proceeding where required. Permitted costs may include search and preparation, reproduction, copying, transcription and delivery.
16. Time Periods
Requests will be processed within the periods prescribed by PAIA, subject to lawful extensions and other circumstances permitted by legislation. Where an extension is lawfully necessary, PIBG will communicate the applicable information to the requester.
17. Form of Access
Where access is granted, PIBG will generally provide access in the requested form where reasonably practicable and legally permissible, taking account of the nature and format of the record, security, protection of third-party rights and applicable law.
18. Remedies and Complaints
Where applicable, a requester may use any available internal remedy. A requester or data subject may also exercise remedies available under PAIA and other applicable law, including lodging a complaint with the Information Regulator South Africa where the circumstances permit.

Measures may include physical, technical, administrative and organisational safeguards.

The PAIA Guide published by the Information Regulator provides guidance on exercising rights under PAIA.
